5.1 受托方应该于本条约签订后 个事情日内开展现场（或试验室）检测事情，于现场（或试验室）检测事情后 个事情日内按照条约约定完成检测事情，并提交书面工程质量检测报告 份。

5.1 The Commissioned party shall, within working days upon the signing of this contract, carry out the on-site (or laboratory) inspection work and complete the same within working days upon commencement of the on-site (or laboratory) inspection work in accordance with the contract, in addition to submit copies of written report of the engineering quality inspection.



第六条 异议处理

Article 6 Treatment of objections

6.1委托方对工程质量检测报告结论有异议，可在收到检测报告之日起 个事情日内向受托方提出书面异议，由双方共同认可的检测机构复检。
复检结论与原检测结论相同，由委托方支付复检用度；反之则由受托方承担复检用度。

6.1 The Client which disagrees with the conclusion of the quality inspection report may, within

working days from the date of receipt of the inspection report for re-inspection, submit the written objection to the Commissioned party, and the re-inspection will be conducted by the mutually recognized inspection agency. If the conclusion of the re- inspection is the same as the original, the cost thereof will be paid by the Client otherwise, will be account of the commissioned party.



6.2 委托方对复检结论仍有异议且无法协商办理的，可在收到复检报告后 个事情日内，向 提出检测程序符合性或检测结论精确性的论证审查。

6.2 Provided that the Client still disagrees with the conclusions of the re-inspection and not possible to negotiate the solution, it may, within working days upon receipt of the re- inspection report, file the validation review of the conformity of inspecting procedures or the correctness of inspecting conclusions to .



第七条 双方权利责任

Article 7 Rights and obligations of the parties



（一）委托方权利责任

(1) Rights and obligations of the Client



7.1委托方应该向受托方供应委托检测的工程概况，并制订该工程的试验操持。

7.1 The Client shall provide the Commissioned party with an overview of the commissioned work of inspection and prepare the inspecting plan for the works.



7.2委托方应该对样品的真实性、代表性卖力，并详细填写检测委托单。

7.2 The Client shall be responsible for the authenticity and representativeness of the samples and shall fill in the inspection commission form in detail.



7.3委托检测前，委托方应该将委托方代表、见证单位和见证职员以书面形式关照受托方。
上述职员发生变更时，委托方应该及时书面奉告受托方。

7.3 The Client shall, prior to commissioning the inspection, notify in writing the Commissioned party of the representative of the Client, the witnessing unit and the witnessing personnel. In the event of any change in the above personnel, the Client shall promptly inform the Commissioned Party in writing.



7.4 委托“见证”检测前，委托方应该供应“见证取样和送检见证人奉告书”，送“见证”检测样品时附“见证记录”。

7.4 The Client shall, prior to commissioning the "witness" inspection, submit the Acknowledgement of Witnessing Sampling and Inspection to the Witness, in addition to accompanying with "Witness Records" to the "witness" inspecting sample.



7.5现场检测项目，委托方应该提前 个事情日将现场检测日期关照受托方,并供应必要的现场检测事情条件。
涉及构造工程质量验收时，见证职员应该到场进行见证。





7.6委托方不得以任何办法哀求受托方修正检测数据出具虚假检测报告。

7.6 The Client shall not in any way require the commissioned party to modify the test data for the purpose of issuance of the false inspecting report.



7.7双方签订本条约后，当工程概况中所列信息以及委托的检测项目等发生变革时，委托方应该与受托方及时办理本条约变更手续。

7.7 The amendment procedure should, subsequent to conclusion of this contract, be effected between the Client and the commissioned party for the variation of the information listed in the project profile and in the inspection items commissioned, etc.



7.8委托方应该根据条约约定，按时支付检测用度。

7.8 The Client shall effect payment of the inspecting fees on time pursuant to the specification hereof.



7.9 委托方有权对受托方未按标准检测的行为和违法违规的行为向干系司法部门举报。

7.9 The Client has the right to file accusation, to the authorities of relevant law enforcement, of any failure by the commissioned party to test in accordance with the standards and any violations of the law.



7.10 委托方应该遵守“单独列支并足额支付检测费”及“检测费不得作为竞争用度”的规定，在条约签订及检测用度结算时不应当哀求折扣。

7.10 The Client shall comply with the provisions of Separate and Full Payment of the Inspecting Fee and No Inspecting Fee Used as Competitive Fee, and shall not demand discounts at the time of contracting and settlement of the inspecting fee.



（二）受托方权利责任

(2) The rights and obligations of commissioned party



7.11受托方应该向委托方供应与本工程检测业务有关的检测能力证明资料。

7.11 The commissioned party shall provide the Client with information proving its inspecting capability in relation to the inspecting business of the project.



7.12受托方承诺与行政机关、法律法规授权的具有管理公共事务职能的组织以及本工程干系的设计单位、施工单位、监理单位无从属关系或者其他短长关系。

7.12 The commissioned party undertakes to have no affiliation or other interests with administrative organs, organizations authorized by laws and regulations to manage public affairs, design units, construction units and supervision units related to this project.



7.13受托方应该严格实行现行有效的规范规程、检测标准，担保检测的公道性、准确性、科学性和有效性。

7.13 The commissioned party shall strictly implement the current and valid code regulations and inspecting standards to ensure the fairness, accuracy, scientificity and validity of the inspecting.



7.14受托方应该在提交检测方案时一并提交检测项目及检测数量。

7.14 The commissioned party shall submit the test items and the quantity of inspection together with the inspection schedules.



7.15受托方应该在双方约定的日期内进场开展检测活动。

7.15 The Commissioned Party shall, on the date agreed between the parties, enter the site to carry out the inspecting activities.



7.16现场检测由于抽样的风险性和抽样后工程的开放性及分外性，受托方仅对当时现场检测出的检测数据及检测报告的真实性和准确性卖力。

7.16 Due to the risk of sampling and the openness and special nature of the works subsequent to sampling, the commissioned party is only responsible for the authenticity and accuracy of the data and reports of inspection detected on site at that time.



7.17受托方现场检测时应该遵守工程安全管理规定及其他工程现场管理制度。

7.17 The commissioned party shall, during on-site inspecting, comply with the regulations of project safety management and other systems of project site management.



7.18对付已纳入培植工程检测信息管理系统内的检测项目，受托方应该利用该系统履行检测和管理，并及时出具检测报告。

7.18 For inspecting projects that have been incorporated in the Construction Inspection Information Management System, the commissioned party shall use the system to implement inspecting and management, and issue inspecting reports timely.



7.19检测结果不合格的，受托方应该及时关照委托方，并有权向培植行政管理部门报告。

7.19 In case of unqualified inspection results, the commissioned party shall promptly notify the Client in addition to have the right to report to the construction administration.



7.20 受托方对检测事情中涉及到的国家机密、商业秘密、个人隐私应该承包管密责任。

7.20 The commissioned party shall assume the obligation of confidentiality in respect of state secrets, commercial secrets and personal privacy involved in the inspecting work.



7.21 受托方不得转包检测业务。

7.21 The commissioned party shall not subcontract inspecting operations to other party.



第八条 违约任务

Article 8 Liability for Breach of Contract



8.1 一方无正当情由单方解除条约的，应该承担由此给对方造成的丢失。

8.1 Provided that a party unilaterally terminates the contract without just cause, it shall be liable for any damage caused to the other party as a result.
